Financial Responsibility in Nursing Home Agreements

The Centers for Medicaid and Medicare Services (CMS) updated its regulations that makes it illegal for the collection of nursing home debt from a resident’s relatives and friends on November 18, 2024. 

Nursing homes cannot request a third-party guarantee as a condition of a resident’s admission or continued stay in a facility according to the non-profit California Advocates for Nursing Home Reform (CANHR). 

This is under 42 U.S.C. § 483.15(a)(3). 

The new guidance is effective February 24, 2025.
